374. How People Make $50K Tax-Free Renting Their Home (Augusta Rule)
Q: What's an effective way to get a rental property out of an S corporation, and is there any viable exit strategy?
Given the complexities, the hosts explain there are two main paths: either distribute the property and pay the taxes now (recognizing potential 1239 ordinary income on distributions of depreciable property) with a possible basis step-up, or liquidate the S corporation and potentially reorganize assets, accepting capital gains implications. They emphasize planning with a advisor to align with family goals and to time any exits with tax consequences in mind.
MLRE: Why Multifamily Is Still Uninvestable (And Where Smart Money Is Going Instead) With Brian Burke
Q: How should LPs think about data centers and AI-related opportunities?
Data centers offer potential but are capital-intensive and less accessible to everyday LPs; Burke notes a bull case on NOI growth but warns about bubble risk and accessibility, suggesting a selective, well-researched approach.
MLRE: Why Multifamily Is Still Uninvestable (And Where Smart Money Is Going Instead) With Brian Burke
Q: Which asset classes do you see as more defensible beyond multifamily?
Senior housing, especially skilled nursing and memory care, is highlighted as a more defensible sector with lower AI-driven disruption and strong demographic tailwinds.
MLRE: Why Multifamily Is Still Uninvestable (And Where Smart Money Is Going Instead) With Brian Burke
Q: What is your current view on the state of the multi-family market?
Burke argues that multifamily has undergone a prolonged downturn, but he believes the space will eventually become investable again as the market stabilizes and interest rates find a new balance; in the near term, he emphasizes caution and a focus on where fundamentals support rents and cash flow.
MLRE: How He Built a $1B Multifamily Portfolio (Without Third-Party Managers) with Rob Beardsley
Q: What is your approach to 1031 exchanges and how do you structure exits to maximize tax efficiency for investors?
We use tenancy-in-common arrangements for investors seeking 1031 exchanges and can facilitate 150M+ in 1031 exchanges. Exiting a property can be coordinated so that investors ride along into the new deal or are bought out, preserving tax deferral and depreciation benefits.
