Q: Did the defendants move for arbitration in an attempt to avoid precedent here?
It is likely they did not move to arbitrate solely to avoid precedent, as defendants can't wait to see how a case is going and then switch to arbitration just because their case isn't going well.

Q: How could a pro-arbitration ruling be immediately appealable as opposed to a non-final interlocutory order?
The hospital's motion to arbitrate was styled as a motion for summary judgment, which was odd because we hadn't done any discovery. However, because of that, and the court dismissing the case, it was considered a final order, allowing appeal.
