  • A great resource!

In my small community, I have held a monthly forum on constitutional issues for nine years. I’m always looking for resources to help me understand and frame controversial constitutional issues. Harder than you’d think to find such conversations as are found in this podcast. I hope John Yoo, Richard Epstein, and Charles Cook continue with this important work.

  • Sea Lawyer

I’m not an attorney, lawyer, or Jurist Doctor but I love this podcast. Hearing both sides of these arguments as well as the occasional agreements from these two ( and now three) eminent counselors is fodder for my active sea lawyering. Put this podcast on your favorites list so you don’t miss any episodes. Great Job and Bravo Zulu.

  • Quality Drop Off

Significant drop in quality since Cooke has joined the team. No apparent mesh as there was with Troy. Cookes accent is grating and he loves the sound of his voice too much. Sad to see a 5 star podcast drop down to a two star level. Ah well, things change. I will listen to Epstein and Yoo on their separate podcasts/discussions/interviews. Double thumbs down on Cooke.

Talking Points

Recent interactions between the hosts and their guests.

The Great Birthright Citizen Debate
Q: Richard, if Wong Kim Ark is such a departure, is such a mess, why is it such a mess?
What he said in 1898 is utterly inconsistent with everything he said and wrote beforehand, and he ignores all of these particular precedents.
The Great Birthright Citizen Debate
Q: If you, John Yoo, were writing a Supreme Court decision for the ages on the meaning of birthright citizenship under the 14th Amendment, who is included and who is excluded?
I would keep the same rule as Wong Kim Ark. It would just say, Wong Kim Ark is affirmed. So it would be the same rule that says, everyone born in the United States is a citizen.
Insurrections, The Militia Cause, and Getting Dunked on By Charles Barkley
Q: What will happen next with Judge Breyer's decision?
The decision is likely to get reversed as the specific conditions warrant allowing federal actions.
Insurrections, The Militia Cause, and Getting Dunked on By Charles Barkley
Q: What caveats or conditions or prerequisites exist on the federalization of the militia or the use of Title X?
Conditions include the presence of an insurrection, rebellion, or inability to execute federal law.
The Professors Strike Back: The 1st Amendment on Campus, ICC's Overreach, and Presidential Immunity
Q: Tom, do you think President Trump is going to walk away with immunity?
It could be complicated, depending on what's deemed official conduct.
