  • Informative for industry professionals and clients alike

As a banker who deals with trust/estate accounts often, and an hopeful future law student, I highly recommend this podcast to clients and colleagues alike. On several occasions I’ve incorporated some of the “work arounds” to help my client accomplish what they need to without making their life unnecessarily stressful.

My only complaint is that Nick is an android guy. Very disappointing. 😂

  • Great podcast

I recently graduated law school and plan on practicing estate planning and estate administration. I listen to this podcast everyday, and even though I am familiar with many of the topics discussed, I find Nick’s explanations and analogies immensely helpful. So thank you guys for putting this out and sorry in advance for stealing some of your phrases to explain these topics to my clients!

Siblings, Partners, and Parents: When Property Ownership Gets Complicated
Q: Should we be concerned about how co-ownership structures are set up at the time of purchase, and how they affect future inheritance?
Yes. The deed structures (tenants in common vs joint tenancy) determine who owns what portion, how that portion passes on death, and how disputes are resolved, so it's crucial to confirm the ownership type upfront and align it with the estate plan.
What Happens to Your Debt When You Pass Away?
Q: If there is a probate estate, what happens to medical bills and other debts in relation to inheritance?
During probate, all bills are paid before any inheritance is distributed, so medical bills and other creditors are prioritized over any assets going to heirs or beneficiaries.
What Happens to Your Debt When You Pass Away?
Q: What happens to debt like student loans when the borrower dies, especially federal vs private loans?
Federal student loans generally are forgiven upon death, while private loans or loans with a co-signer may have different rules and require evaluating the loan terms and whether a cosigner or refinance changes the outcome.
I Just Asked for a Will. Why Is My Lawyer Preparing All These Other Documents?
Q: When does trust planning conversation come into play?
It comes into play when the attorney assesses that a trust may be more appropriate for managing inheritance compared to a simple will.
I Just Asked for a Will. Why Is My Lawyer Preparing All These Other Documents?
Q: Why do people begin kind of the process just thinking, okay, I just need a will?
Because it's the most common estate planning document people are familiar with, stemming from societal conversations and media portrayals.
