  • Really helpful

My parents attorney set up their trust and I found out it wasn’t funded. Basically useless. They have met with him 3 times. 4th time I am going with them and he is getting fired. This podcast is a lifesaver and I really enjoyed the thoughtfulness they put into these conversations.

  • Informative for industry professionals and clients alike

As a banker who deals with trust/estate accounts often, and an hopeful future law student, I highly recommend this podcast to clients and colleagues alike. On several occasions I’ve incorporated some of the “work arounds” to help my client accomplish what they need to without making their life unnecessarily stressful.

My only complaint is that Nick is an android guy. Very disappointing. 😂

  • Great podcast

I recently graduated law school and plan on practicing estate planning and estate administration. I listen to this podcast everyday, and even though I am familiar with many of the topics discussed, I find Nick’s explanations and analogies immensely helpful. So thank you guys for putting this out and sorry in advance for stealing some of your phrases to explain these topics to my clients!

Your Child Turned 18… Is Your Estate Plan Still Valid?
Q: What happens if you have your child turn 18, and you've made a bunch of plans in your estate plan for them when they were a minor? What happens when they're an adult?
The guardian designations that only apply if the child is a minor do not automatically vanish at adulthood; you should review and possibly adjust the timing of inheritance distributions and consider whether the child should become a fiduciary in the future. The will itself does not need to be completely redone simply because the child turned 18, but it is a good opportunity to revisit and ensure the plan still matches your goals.
I Was Named Executor… Do I Have to Say Yes?
Q: What are the main duties of an executor to avoid liability?
Preserve and safeguard assets, pay debts and taxes, and manage distributions carefully; neglect or mismanagement can lead to personal liability for the executor.
I Was Named Executor… Do I Have to Say Yes?
Q: What happens if there is no backup named in the will?
There will typically be a probate process where a volunteer or appointed successor steps forward, and the court may appoint the next suitable person to handle the estate.
I Was Named Executor… Do I Have to Say Yes?
Q: If someone is named executor and wants to decline, what should they do?
They should consult an attorney, sign a document acknowledging they are declining, and follow the legal process to step down, ensuring there is a named backup or a court-approved successor.
My Parents Won’t Do Their Estate Plan. Can I Do It For Them?
Q: How involved should the parents be, and how proactive can the worried child be in moving this forward?
The host emphasizes that while the child can facilitate, the parents must be willing to come in, answer questions, and decide to proceed; the child can report back and set up meetings, but cannot hire or finalize on behalf of the parent without their buy-in.
