闗於台灣<同性結婚公投>，初始爭議為司法院釋字748號解釋認為「民法關於婚姻規定，沒有保障相同性別者的婚姻自由權及平等權而宣告違憲，相關機關應在2年內完成修法或制定」，至於直接修改民法或是設立「同性伴侶法」等專法，大法官會議未下說明。因此該次公投題目是否同意修改民法，將同婚納入民法規範？
而關於<同性結婚公投>
當時台灣民間在吵的，一直就是在於若是修改「民法」納入同性婚姻，或另立專法以保障同性結婚權的問題。
@同志團體認為，修改民法是對同性婚姻的一種尊重，代表國家承認同性戀，並給予選擇婚姻自由的保障，與異性戀一視同仁，享有與異性戀婚姻一樣的權利和義務，代表一種尊嚴。而另外定訂專法，例如同性伴侶法，則同志團體認為是歧視、假平等，是一種「隔離但平等」的做法。隔離但平等，是法律用語。就如，往昔美國有種族隔離政策，學校、電影院和餐廳分白人和黑人，雖然黑人小孩能上學，與白人小孩一樣平等，享有受教育權利，實際上則是歧視。
然而最終公投結果是，「將同性結婚納入民法規範」之公投未過，因此才以增訂專法方式使「相同性別之二人，得為經營共同生活之目的，成立具有親密性及排他性之永久結合關係。
