I know I’m late on this but isn’t it odd that 2 random people killed happened to be in drug trade ? Maybe 2 random things could have happened at once … the guys were there for a drug deal (why else would Brian blow pff his friends ) and the Serial Killer happened to stumble across them .

I like the show but the Monday morning quarterbacking on trial counsel ineffectiveness is tough. Hosts: please list all jury trials where you were lead counsel and I’ll give you more credibility

Édit: I’ve now listened to season 1 as well, and understood the genesis of the podcast and I take back my criticisms below and have increased to 5 stars. One of my very favourite podcasts. I love all the presenters now I’ve listened to so much. Thank you!

I’m listening to series 2 at the moment. I absolutely love this podcast- the level of detail and way of talking through and explaining everything is great. I love all the legal explanations and cultural and literary references. I have taken of... more

  • took me until now to realise…

why susan is no longer on this podcast: because colin is the only intelligent person on here now. used to love this podcast and their deep dives but now it’s anything but and most of what rabia says now is uninformed and moronic. sad because colin is so smart and explains complex issues very easily

Talking Points

Recent interactions between the hosts and their guests.

TJ Weekly - Davontae Sanford
Q: How did the confession get used in court and why was there no proper Miranda warning?
He describes two confessions, one initially not used, the second obtained under pressure with inaccurate details, and the Miranda warnings were either poorly delivered or not clearly explained to him as a juvenile.
Tj Weekly - Charles "Sonny" Burton
Q: What is the broader significance of the clemency outreach and public advocacy in this case?
The hosts discuss how jurors, the victim's family, and public advocacy can influence clemency decisions, including letters, op-eds, and organized vigils, illustrating clemency as a vehicle to rectify perceived injustices in death penalty cases.
Tj Weekly - Charles "Sonny" Burton
Q: How does the clemency process work in Alabama, and what role does the governor play in setting an execution date?
Donna outlines that the Attorney General moves for a court to authorize clemency consideration and a date setting, with the governor ultimately deciding whether to commute or set a date, and notes that the petition is currently with the governor with significant public support.
Tj Weekly - Charles "Sonny" Burton
Q: Matt, can you walk us through what Sonny Burton was charged with and why it qualifies as capital murder rather than felony murder?
Matt explains the distinction between felony murder and capital murder, noting that Burton was part of an armed robbery and that while the shooter faced the murder charge, Burton's conviction for capital murder rested on a particularized intent-to-kill standard, which the defense argues was misapplied in jury instructions.
TJ Weekly - Cece Woods
Q: Why would the jurors have been biased?
Some jurors were part of a Facebook group that was campaigning against Rebecca, indicating potential bias in the jury's decision.
