  • Re Nick Humphries episode

Given lawyers charge by the hour, I would want Mr Humphries to exclude from his bill all the times he says “ummmmmmm”. Which would cut his bill in half but,no doubt, be still eye watering expensive.

Talking Points

Recent interactions between the hosts and their guests.

Jurgen Klopp's Liverpool payoff, would an NFL-style wage cap work in the Premier League?
Q: Why do some folks argue for an NFL-style wage cap in football?
To level the playing field by limiting overall expenditure on players, though there are enormous practical hurdles like taxes, amortization, and the incentives built into contracts.
How Premier League clubs' Foundations work, financial settlements for coaching staff
Q: How does a manager's sacking affect staff severance and overall costs?
Typically, the manager's compensation dominates the costs, but the entire coaching staff can be involved in severance packages; clubs often treat staff as a unit and their salaries, redundancies, and potential new hires all influence the final figures.
How Premier League clubs' Foundations work, financial settlements for coaching staff
Q: What is PSR, and how does it influence a club's accounting choices?
PSR is largely calculated from profit before tax, and the rules can differ between UK GAAP and IFRS; choosing one framework or switching between them can change the reported PSR and potentially affect transfer-related numbers.
Interview: manager contract lawyer Nick Humphreys
Q: Could a manager claim constructive dismissal if the promised budget or resources are not delivered by the club?
Constructive dismissal arises when there's an implied term of trust and confidence breached, which would have to be well-documented and proven, often requiring concrete evidence of a breach rather than a vague oral promise.
Interview: manager contract lawyer Nick Humphreys
Q: You mentioned there, Nick, that managers have an obligation to find alternative employment which pays the same or more. How does that typically work in practice?
In practice, contracts can expressly require mitigation, sometimes with a schedule of payments and a clear timeline. If a manager secures a comparable role, payments may be adjusted to reflect new earnings and the overall damages are calculated as the unexpired term value less mitigation.
