  • Practical & Concise

As someone managing two divorced, aging parents who have done no more than a simple will, it is a real mountain to climb! I wish that I had known about this podcast earlier! Mom’s planning is mostly done, and now I’m working with my Dad. I’m also doing my own planning so that my two children don’t have to worry about all this stuff when my decline begins or if I pass away unexpectedly. Thank you Jill!

  • I’m 78 years old and still learning

I thought I knew everything I needed to know about estate planning, but I was wrong. I love how Jill explains everything in such an accessible way. I’ve shared her podcast with my adult children, who love it, too. It’s been a great way for us to engage in family conversations about death and incapacity.

How to Take Your Estate Plan Off Script
Q: What are the drawbacks of the mandatory family trust portion in Abby's firm's forms for Joe and Jane, given their current estate sizes?
The mandatory family trust can unnecessarily restrict the surviving spouse's control and flexibility, potentially pulling assets back into the deceased spouse's estate for tax purposes and limiting adaptability if tax exemptions change; the episode suggests making funding optional or using a disclaimer mechanism to preserve flexibility while still achieving goal-oriented outcomes.
How to Avoid Mistakes with Debt After Death
Q: Do we have to pay our loved ones credit card bills after their death?
In most cases the survivor is not personally responsible, but there are exceptions such as cosigning, joint accounts, and state-specific rules; Virginia law also outlines a priority order for paying debts from the estate.
Why Estate Plans Fail Adult Children
Q: My parents had a revocable trust drafted, but the attorney never funded it. What does that mean for the family?
It means the trust exists on paper, but without funding, the assets stay outside the trust and still go through probate; this creates costs and administrative burdens for the family, and the plan isn't actually effective.
Why Your Aging Parents Aren’t Planning and How to Change It
Q: What would be your recommendation and next step?
Start with a joint, collaborative approach that identifies assets, capabilities, and goals, then partner with an experienced estate planning attorney to create a step-by-step plan including powers of attorney, medical directives, and a funded trust where appropriate; involve the parent in decisions and ensure information is shared with the family on a need-to-know basis with consent.
What Really Happens with DIY Wills and other Lessons from the Bench
Q: Why are DIY wills problematic from the bench?
DIY wills often miss precise language, ordering, and catch-all provisions, leading to multiple possible interpretations and substantial additional legal work to resolve after death, which can be far more expensive than proper upfront planning.
