  • Excellent podcast that keeps you up to date on legal issues and current events. I don't have a legal background, but feel it's critical to stay up to date on what going on in our courts. I never miss a podcast. Cannot recommend this presentation by Andrew Weisemann and Mary McCord enough. Excellent

  • Exceptional

As a lawyer, I am so grateful for the work that Mary and Andrew are doing to distill all of the important cases that continue to drop out there. This is one of the few podcasts that I listen to every week. The nation needs to understand how fragile the rule of law is under this administration, and this show helps to explain just how.

  • Clarity amidst the chaos

Andrew & Mary exceptional. I’ve not missed an episode since before the pod name change. They seamlessly breakdown down complex legal developments - often in real time - in a way that is accessible and deeply informed. This pod is a steadfast treasure in these chaotic and uncertain times.

  • best of all

This is, in my world, the very best pod. To me it's like the Maddow show -- always worth more attention, another listen, quiet, thoughtful time with a good cuppa.

  • How do we send you questions?

I can’t find how to send questions to you so my apologies for using “Review” to send my question. Is there a way to preemptively bring a case to SCOTUS before a crime has occurred? For example, could SCOTUS rule that elections cannot be nationalized before Trump actually takes steps in that direction (and succeeds)? It seems that waiting for it to become a reality will be too late to bring that case to SCOTUS.

Talking Points

Recent interactions between the hosts and their guests.

“Dishonorable and Inhumane”
Q: What is the legal basis for the use of lethal force against shipwrecked individuals?
International law prohibits the killing of shipwrecked survivors, designating such actions as a war crime.
“Dishonorable and Inhumane”
Q: What obligations does a military officer have regarding following orders that are clearly illegal?
All ranks have a duty not to follow patently unlawful orders, but lower ranks may presume orders are lawful unless clear evidence suggests otherwise.
“Dishonorable and Inhumane”
Q: Assuming the government's position is correct, that we're in some armed conflict between a nation state and a non-nation state, what are our legal obligations under domestic or international law?
The duty could be to not target the two individuals who are shipwrecked, as they are out of the fight and protected under international law.
Honoring Veterans Day
Q: What does Congress have the power to do regarding war powers?
Congress has the authority to declare war and has mechanisms to require the withdrawal of armed forces if hostilities are declared or imminent.
Honoring Veterans Day
Q: What is supposed to happen if these were considered to be hostilities?
There would be a serious evaluation if the president had authority under domestic law and whether it was lawful under international law, leading to the conclusion that no strike ever would have been taken.
