So I have always enjoyed the short time on 99.7 mostly my favorite thing in the blitz. Been listening since you first started talking on 99.7 lol but never pod cast until two weeks ago. Think I’ve gone through 60 pod casts in 2 weeks. I listen all day at work and absolutely enjoy it, the knowledge is incomparable with any issue you guys cover. I only wish I could have you as my lawyer! Thank you for all you do!

Talking Points

Recent interactions between the hosts and their guests.

Breaking Down Privilege Issues Raised by Chiles v Salazar
Q: Is this privilege applicable to a therapist–client conversation under Colorado law, and does privilege necessarily protect what is said from government scrutiny?
The host explains that privilege may exist in a conversation (when confidential and with the right conditions), but even if privileged, the government can still outlaw or regulate certain statements; the core issue is that government action can criminalize what is said, regardless of privilege, and privacy boundaries can be breached in investigations.
How States Take Cases to the US Supreme Court
Q: According to the Constitution, if a state is a party, then does the Supreme Court have original jurisdiction?
It generally does not have original jurisdiction in most cases involving states; there are narrow, exclusive circumstances, and usually those matters start in lower federal courts before possibly moving to the Supreme Court.
Can a Trial Be Moved?
Q: His question is, can you be charged and brought to trial in a different county slash parish and district where the crime is said to have been committed?
Venue generally dictates that a criminal trial is held where the crime occurred, though the rule can be complex when crimes span multiple counties or are highly publicized; changing venue is possible but often difficult and requires showing that a fair trial cannot be had in the original county.
When Does The Right to Counsel Officially Begin?
Q: When does your right to counsel attach?
The right to counsel attaches at the instigation of formal adversarial proceedings, which is defined as beginning at the preliminary hearing rather than during the interrogation process.
Can You Sue the Police? Time Limits and Legal Details | Lawyer Talk Q&A
Q: Is there a statute of limitations for suing the police?
Yes, there is a statute of limitations, and it varies by state.
