  • They do a great job of providing information that I wasn’t of

I was particularly found of the RUOK day episode because the Callover discussed the availability of Lawcare.

I am a QLS member and I had no idea this service was offered. Overall, the QLS does a terrible job of providing useful information to its members, but if they keep providing information on services like they did that episode I will take it as a positive for the organization.

I think all QLS members should subscribe and listen to the Callover.

The Art of Taking Witness Statements with Emma Hoiberg
Q: What ethical obligations must be mindful of when taking witness statements?
Two key obligations are avoiding coaching or prompting false evidence (Rule 24) and not conferring with multiple lay witnesses about contentious issues (Rule 25), with emphasis on testing the witness's recollection through open questions.
The Art of Taking Witness Statements with Emma Hoiberg
Q: What are the main purposes for taking witness statements at different stages of a case?
Early-stage statements gather information to assess whether to commence litigation, while trial-stage statements focus on evidence relevant to the issues in dispute and admissibility, aligning questions with what needs to be proved at trial.
The Art of Taking Witness Statements with Emma Hoiberg
Q: Is there a difference between a witness statement and an affidavit, and when would you use each?
An affidavit is a formal, sworn document filed for evidentiary purposes, whereas a witness statement is a less formal account of the witness's evidence used for information gathering or trial preparation; affidavits require sworn compliance, while statements may not.
The Art of Taking Witness Statements with Emma Hoiberg
Q: Before we dig into how to prepare a good witness statement, what is your journey in the law and how did it shape your approach?
Emma describes a spectrum of experiences—from clerical roles to associate at the High Court and later roles in private practice and reform commissions—highlighting how exposure to varied legal work informs a practical, journey-driven approach to witness statements and trial preparation.
