  • Awesome podcast missing just one small thing

This is a great service and thanks to whoever is behind it. That said, I’d be so grateful if you’d consider adding judge names for federal circuit courts.

  • Great podcast

Great podcast! The only thing that would make it even better is if it included in the description the names of the judges (for circuit courts) and advocates

  • Must subscribe podcast

Love this podcast. All the SCOTUS oral arguments posted ina tiely fashion, in addition to timely and interesting lower court cases. It's rare a big case I'm following is not included. If someone focuses on appellate advocacy and the courts, this is a must listen.

Talking Points

Recent interactions between the hosts and their guests.

U.S. Supreme Court Pung v. Isabella County, Case No. 25-95
Q: Is the historical practice more that what happens in federal lien law or is this a new creation by states?
Historically, the states have used the foreclosure process followed by an auction to recover unpaid and delinquent property taxes.
U.S. Supreme Court Pung v. Isabella County, Case No. 25-95
Q: Could you spell out what you think the county was obligated to do?
At that point, there would be a forfeiture, which is a unique aspect of Michigan law, followed by a foreclosure where they assume and take title to the property.
U.S. Supreme Court Pung v. Isabella County, Case No. 25-95
Q: What do you do with the fact that the English and American legal traditions seem to permit these sorts of foreclosures?
The fact that our history allows for these types of foreclosures is only one half of the equation, as protections have been built in historically.
U.S. Supreme Court Havana Docks Corp. v. Royal Caribbean Cruises, Case No. 24-983
Q: Did the Cuban government from the beginning have what would be the equivalent of a fee-simple interest in the pier?
Yes, at all times relevant here, the Cuban government had the underlying ownership of the docks, but they had provided for control of the docks and possession of the docks to go to Petitioner for the term of the use of those docks.
U.S. Supreme Court Havana Docks Corp. v. Royal Caribbean Cruises, Case No. 24-983
Q: What exactly is the property here that has been confiscated?
The interests that were taken from us are the equivalent of a leasehold and comprised the docks, the land, the rights to operate those, the concession and machinery.
