  • Awesome podcast missing just one small thing

This is a great service and thanks to whoever is behind it. That said, I’d be so grateful if you’d consider adding judge names for federal circuit courts.

  • Great podcast

Great podcast! The only thing that would make it even better is if it included in the description the names of the judges (for circuit courts) and advocates

  • Must subscribe podcast

Love this podcast. All the SCOTUS oral arguments posted ina tiely fashion, in addition to timely and interesting lower court cases. It's rare a big case I'm following is not included. If someone focuses on appellate advocacy and the courts, this is a must listen.

  • Super interesting.

You get the Supreme Court arguments that you can get from other podcasts like Oyez. But then you get a wide selection of interesting cases in the lower federal courts and the state courts.

Talking Points

Recent interactions between the hosts and their guests.

USCA, Sixth Circuit Smith v. SEC, Case No. 24-3907
Q: The fact that Jarkasy was two months before this decision makes a particularly easy case.
I think that's wrong because we have a bunch of cases where they took this on.
USCA, Sixth Circuit Smith v. SEC, Case No. 24-3907
Q: Have you raised this issue before the SEC in the appellate process that you thought their structure was unconstitutional along the lines of Jarkesy?
Well, before Jarkesy, the SEC had been pretty consistent in case after case, both in adjudications and in its briefing in the Jarkesy case in the Fifth Circuit and the Supreme Court, that there are no jury trials for SEC cases.
USCA, Sixth Circuit Smith v. SEC, Case No. 24-3907
Q: Why doesn't he follow the terms of the statute? Why doesn't he follow the terms?
Well, that was a hotly disputed question of fact. And for that reason, it should have been decided by a jury, not by Finra in the first instance.
USCA, Sixth Circuit Smith v. SEC, Case No. 24-3907
Q: Is that a statutory argument you are making or a constitutional one?
It's pretty much a statutory one. They're trying to take a statutory definition.
U.S. Supreme Court Ellingburg v. United States, Case No. 24-482
Q: What do you think about these provisions that say that the award is offset by any civil judgment received?
Those provisions support that restitution is part of punishment and not merely civil.
