  • Shell of former program

This was my “Ride or Die” podcast for so long - back when the Supreme Court was (mostly) independent. Now it’s mostly painful to listen to; literally and figuratively (Norm Eisen, Biden apologist?!?). Will not delete because some of the most interesting cases have been dissected on this show.

  • Justice for Lindy

But slate is now obsessed with dragging Lindy West as much as possible to cling to relevance and it’s really sad. I didn’t even like her book that much but I don’t think that it’s a good look for slate to be treating her like she’s evil because they don’t think she’s okay with her polyamorous situation. They might be right but I don’t think she deserves what they are doing to her. And slate hasn’t been good since Danny Lavery left anyway.

  • Why I subscribe

I listened to Amicus for one or two years before subscribing. I subscribed not to skip the ads, but to support a quality of legal analysis that I, as an attorney since 1979, recognize as spot on. Given the quality of the main show, I didn’t believe that the bonus episodes would be worth paying for. I was wrong. I admire, respect, and enjoy Mark Joseph Stern’s bonus commentary. There is no podcast that I have followed longer than Amicus.

Talking Points

Recent interactions between the hosts and their guests.

Preview: This War is Obscenely Illegal
Q: Can we maybe start with the constitutional layer of the sandwich? Under the Constitution, does the president have the power to declare war?
The answer, of course, is no. The Article 1, Section 8 of the Constitution has always provided that the power to declare war is vested in Congress, and the president can only act without Congress in narrow imminent-threat situations in advance of formal authorization.
Return of the Abortion Pill Wars
Q: Why is Mifepristone such a focal point for anti-abortion activists and a litmus test for federal vs. state control?
Because it epitomizes how access to abortion can be expanded via telehealth and mail, which threatens state-level control narratives; the discussion emphasizes how the drug symbolizes larger battles over reproductive autonomy and federalism.
Return of the Abortion Pill Wars
Q: What do you think explains the Supreme Court's decision not to provide a full reasoning for the stay?
The host and guest suggest it reflects a strategic, conservative approach to avoid signaling too much while managing a controversial issue, and they discuss how the decision fits into broader narratives about standing and access.
The “Civility” Problem for Judges
Q: What should the public understand about judicial independence?
Independence means decisions are based on law and evidence, not political pressure or personal affiliations; there must be due process for all parties, and there must be accountability when judges deviate from these principles.
The “Civility” Problem for Judges
Q: What makes this moment different for judges now than in the past?
Judges face higher volumes and intensities of threats, amplified by social media, plus a political climate where attacks can come from high-ranking officials and political rhetoric has grown coarser, creating an environment where independence is continually tested.
