  • Best SCOTUS Analysis Podcast!

I have subscribed and followed just about every SCOTUS podcast there has been since the pandemic. Most were a flash in the pan. Most of the rest are so loaded with snark and attitude that it clouds the quality of the legal analysis. Amicus stands head and shoulders above the rest.

Dalia Lithwick and Mark Joseph Stearns have carefully laid exactly how the justices on this Supreme Court have stopped practicing law.

    1) There has to be an actual controversy? No. 2) The plaintiff must have ... more

First rule of womens fight clubs across the world: Don’t argue or debate with men about abortion. Men go through none of the physical issues with abortion or a pregnancy. Mens voices should be silent yet women with power have allowed them to once again control us and note for the record, I am not a male hater. control over my own body without meddling and legal coercion to steal my rights to my body is wrong. Mens voices on the abortion issue is absurd and we have to stop them having the control... more

  • Shell of former program

This was my “Ride or Die” podcast for so long - back when the Supreme Court was (mostly) independent. Now it’s mostly painful to listen to; literally and figuratively (Norm Eisen, Biden apologist?!?). Will not delete because some of the most interesting cases have been dissected on this show.

  • Justice for Lindy

But slate is now obsessed with dragging Lindy West as much as possible to cling to relevance and it’s really sad. I didn’t even like her book that much but I don’t think that it’s a good look for slate to be treating her like she’s evil because they don’t think she’s okay with her polyamorous situation. They might be right but I don’t think she deserves what they are doing to her. And slate hasn’t been good since Danny Lavery left anyway.

Talking Points

Recent interactions between the hosts and their guests.

A Huge Shift is Underway at SCOTUS
Q: How should non-civil rights attorneys understand the Office of Legal Counsel's stance on disparate impact liability and what it implies for enforcement of the civil rights statutes?
Disallowing disparate impact liability reframes many voting rights and employment discrimination issues around intent, potentially limiting remedies for discriminatory effects and shrinking the tools available to challenge discriminatory practices.
A Huge Shift is Underway at SCOTUS
Q: So maybe just to set the table, Pam, can you try to encapsulate for us what has shifted on the ground in the last couple of weeks at the court?
The Court has moved to effectively eviscerate key protections in the Voting Rights Act and related civil rights frameworks, signaling a broader shift toward narrowing Congress's remedial powers and increasing the court's own role in shaping voting and election law.
The Roberts Court Shows Its True Colors
Q: Andrea, can you describe how asylum at the border is supposed to work under the Refugee Act and what went wrong in the recent cases?
Andrea explains that asylum is a procedural right tied to the 1980 Refugee Act, intended to allow people who arrive to seek protection; the Court's decisions largely undermine this framework by narrowing access and creating loopholes that push responsibility back onto border agents rather than ensuring a clear, humane process.
Trump’s Slush Fund Is Even Worse Than You Thought
Q: What is the genesis of the litigation in January, and why does Trump, as a private citizen, sue the IRS and Treasury for $10 billion?
The origin was a pursuit by Trump after leaks of his tax returns; the suit framed as a private citizen challenging the IRS and Treasury, leading to a controversial settlement that rewrote who pays and who is protected, with actions bypassing typical government channels and oversight.
Preview: This War is Obscenely Illegal
Q: Can we maybe start with the constitutional layer of the sandwich? Under the Constitution, does the president have the power to declare war?
The answer, of course, is no. The Article 1, Section 8 of the Constitution has always provided that the power to declare war is vested in Congress, and the president can only act without Congress in narrow imminent-threat situations in advance of formal authorization.
