  • Why I subscribe

I listened to Amicus for one or two years before subscribing. I subscribed not to skip the ads, but to support a quality of legal analysis that I, as an attorney since 1979, recognize as spot on. Given the quality of the main show, I didn’t believe that the bonus episodes would be worth paying for. I was wrong. I admire, respect, and enjoy Mark Joseph Stern’s bonus commentary. There is no podcast that I have followed longer than Amicus.

  • Legal Blinkers, Moral Hazards

I listen to all Amicus podcasts and have done so for a number of years. I am usually in agreement with the perspectives offered by Dahlia and Mark but I also usually learn something about the law with each episode that I didn’t know before.

That said, I think the episode “Legal Blinkers, Moral Hazards” is, perhaps, the most important episode you have done. However, I suggest a slight modification to the title: How about “Legal Blinders, Moral Hazards”?

  • Vital listening

I have been listening to the Amicus podcast for a decade or so, and it has provided me with incredible knowledge and understanding of the American political system, expanding far beyond SCOTUS alone. Listening is very challenging at times, binging podcasts will leave you wanting to lie down in a dark room. But Dahlia (and Mark!) make you feel like you aren’t alone! They provide succinct and clear translation and interpretation of what feels like incomprehensible legal jargon indecipherable legal... more

Talking Points

Recent interactions between the hosts and their guests.

Preview: A Blowout for Birthright Citizenship at SCOTUS
Q: Do you agree?
I agree that only about two justices seem seriously willing to uphold the order, while seven appear aligned with the lower courts and the constitutional bar against the executive action.
Trump Has a Plan for the Midterms, SCOTUS May Help
Q: Can you give me the sort of back of the envelope, what you're working on now and how you pick those cases, Ian?
Ian explains a four-question framework: importance to stopping autocracy, viability of a legal theory, whether others are already tackling it, and capacity to take it on, which together determine whether Protect Democracy files a case and how they build a broad, coalition-based strategy beyond litigation alone.
Church and State are Being Reunited, Thanks to SCOTUS
Q: Tell me what you're watching in terms of how the Court is evolving on church-state separation and religious freedom.
Rachel Laser outlines how the Roberts Court, influenced by a network of conservative legal organizations, is moving toward greater accommodation of religious claims while eroding limits on government endorsement of religion, with recent shadow docket moves illustrating the shift.
Yes, Supreme Court Decisions Really Matter
Q: How do you differentiate what people think the SG does from what you actually did in that office?
He describes a dual obligation: advancing lawful policy objectives and maintaining institutional independence, balancing respect for the presidency with the duty to uphold the rule of law and the integrity of the office, even under presidential pressure.
Yes, Supreme Court Decisions Really Matter
Q: Can you talk for a minute, Don, about who you answered to as SG?
Verrilli explains that the SG is not the president's personal lawyer; the office is supposed to exercise independent judgment and protect the long-term interests of the United States, sometimes opposing White House policy when necessary to preserve the credibility of the administration and the Department of Justice before the Court.
