  • The Lindsay Chervinsky episode

    Outstanding !

One of the best podcasts I have ever had the pleasure to listen to. There were so many wonderful nuanced nuggets of historical /constitutional gold.

I am really looking forward to reading all of her work. Great conversation.

  • The recent addition of Kate Klonick

I’ve appreciably gotten used to a certain level of professionalism among the hosts and commenters. Ms. Klonick’s repeated use of “like” and squeals and over-the-top emotional outbursts ain’t that. Could you tone it down a bit? My ears hurt…

  • “Sweet Dreams…”

So at least one of you thinks it’s just fine for a masked plainclothes person to snatch anyone they want off the street and do who knows what to that person because nobody knows who or what the snatcher is.

  • No more “ew” factor, please.

I’d like Ben to leave his women issues out of the podcast. He makes a point of “joking” that one episode was all men — “And NO women!” he repeated. We get it: you had a domestic spat and so now we all need to hear about it. I’ve also found it strange that Ben should regularly (and uncomfortably) flirt with a female reporter during episodes. Ew. Just stick to the facts and legal cases, please. That’s why we listen.

Talking Points

Recent interactions between the hosts and their guests.

Lawfare Daily: The U.S. Foreign Service at a ‘Breaking Point,’ with John Dinkelman
Q: How does low morale affect the work of a Foreign Service Officer?
Low morale leads to increased worry among officers about their job security, thus hindering their ability to serve effectively.
Lawfare Daily: The U.S. Foreign Service at a ‘Breaking Point,’ with John Dinkelman
Q: What was your reaction to the high response rate?
The high response rate indicated significant unhappiness among Foreign Service officers, as 86% reported their job performance was inhibited.
Lawfare Daily: The U.S. Foreign Service at a ‘Breaking Point,’ with John Dinkelman
Q: What motivated the report?
The federal government decided to stop conducting its annual survey on workplace conditions, prompting the American Foreign Service Association to step in and assess the state of the Foreign Service.
Lawfare Daily: The Latest in Iran, with Richard Nephew
Q: What military options are on the table for the U.S. regarding Iran?
The U.S. could engage in limited operations that don't commit to overarching military campaigns, focusing instead on specific targets to support protesters.
Lawfare Daily: Mary Clare Jalonick on ‘Storm at the Capitol’
Q: Can you sort of walk us through why you think this was such an important event to document in the fashion you did?
I think that people can make their own conclusions about the significance of the event. Obviously, it was the worst attack on the Capitol in 200 years. One of the main reasons for writing the book was that there has been a lot of misinformation around it and a lot of attempts to downplay what happened.
