  • Tiger Woods

Both lawyers on this podcast are the reason our judicial system is broken. You were on the side of giving Tiger a pass. Tiger needs to go to jail. He, and other rich and famous, need to stop being able to get by the law. Look at Robert Downey Jr. he finally had to go to jail and he finally changed his life.

Love the topics, but the host really doesn’t know how to host. Garcia doesn’t let her guests get a word in edgewise. Why have guests?

Talking Points

Recent interactions between the hosts and their guests.

Roommate charged with killing doctoral students; Man facing death penalty asks to go pro se – TCN Sidebar
Q: What about the speedy-trial right? Could a waiver by an attorney without the defendant's consent cause issues before the trial even starts?
The analyst explains that a personal waiver by the defendant is typically required for a speedy-trial waiver, and shared concerns suggest potential issues if counsel acted without the defendant's consent, which could affect motion outcomes.

Q: Where do you think the courts will come out on the idea of a defendant representing himself in a capital case and waiving counsel?
The guest suggests that while there is a constitutional right to counsel, there is also a path for self-representation under certain conditions, but the defendant's level of qualification and risk to the integrity of the trial remain major hurdles.

Q: My first question is, we seem to have a bunch of cases where Google searches and now ChatGPT queries have played a pivotal role. Is this somehow worse or more effective in prosecutions?
The host and guest discuss that search histories and AI prompts can reveal a defendant's intentions and planning, making such evidence potentially powerful for prosecutors, but also raise questions for defense about context, intent, and how this information was obtained.
Stefon Diggs acquitted of strangulation, assault; Why hasn’t a suspected child killer been charged? – TCN Sidebar
Q: What were your thoughts on her testimony under cross?
Her testimony appeared unconvincing to the jury, and the cross-examination exposed inconsistencies that undermined the prosecution's narrative, influencing the swift two-hour verdict.

Q: Imran, I know you watched some of this. What was your take on this? This is supposed to be the star witness for the prosecution. This is the complaining witness, the person who is claiming she is a victim.
The witness's credibility was crucial, and the cross-examination revealed significant weaknesses; the jury likely saw the inconsistencies and the defense highlighted the lack of visible injuries and motive, contributing to the not-guilty verdict.
