Q: Angie asked, can you elaborate more on New York having the burden rest on the school that they provided a FAPE instead of that being on the family to prove that FAPE burden? Explain how this shifts the dynamic and when it started in New York.
New York State DOE attorneys are required to prove that a free appropriate public education was offered. In practice, this means the DOE may present documents, an IEP, and evaluations to support their case, while the family presents evidence showing why the program failed to meet the child's needs. This burden shift dramatically changes the dynamics, as the district bears the responsibility to justify the IEP and its implementation, rather than parents having to prove a negative. The impact is that families in states with DOE burden may face fewer hurdles in establishing FAPE as compared to states where the burden lies on the parent.
