今回は民法の中でも、より実践的な問題から、「民法のエッセンス」に迫っていきます。
テーマとなるのは、100万円の壺を誤って「10万円で売るよ！」と言ってしまい、買主が「10万円なら買います！」と返事をしてしまった場合、売主は「10万円では売れません！」と後から言えるのかどうかというケースです。
こんな時、売主の目線で考えるか買主の目線で考えるかによって、事案の見え方が大きく違ってきます。

いよいよ私達にとって身近な法律、民法に入っていきます！はじめに考えるべき問いは、「殺人契約も有効か？」。みなさん、どう思いますか？
民法の大原則として「契約自由の原則」というものがあるので、その意味では、殺人契約というおそろしい契約も有効とされるのでしょうか？でもそうすると、「殺人」という許されえない行為について、裁判所が認めることにもなりかねません。

今回は憲法の応用編として、「外国人にも日本国憲法上の人権は認められるか？」という問題や、「憲法上の自由や人権の制約は認められるのか？」という問題を扱います。
憲法と聞くと縁遠い感じがする人も多いかもしれませんが、これらの問題は、現代でも外国人労働者の処遇に関するニュースや表現の自由に関するニュースなど、日々目にする社会問題に大きく関わっています。

哲学に詳しくない人でも楽しめる内容を期待して初回を聞いてみましたが、タッシーさんという方の噛み砕いた例えが中々しながわさんに響かず、いまいち会話が盛り上がらない。結局解説はインテリチックな香りが残ったまま。半分くらい聞いて断念しました。
