  • Great way to keep up with the best of legal scholarship

Love this podcast. Brian asks good questions but like a good interviewer he basically gets out of the author’s way. I have learned so much from just a few episodes and what else could you ask for? It’s like a really good law conference you can listen to at any time (like while commuting!)

Davies & Ellis on Brakhage & Sartre
Q: What did Brakhage do and what was the history of his contribution to that film project?
Brakhage's primary contribution is a segment tied to the Sartre passage, known as Sartre's Nausea, filmed for the Barnes series, with archival uncertainty about additional pieces; other parts of the series may reflect Brakhage's style but evidence is inconclusive.
Davies & Ellis on Brakhage & Sartre
Q: So maybe you could then just briefly explain the context in which Brakhage and Sartre overlap in the production of this film in which Brakhage contributed a segment?
The overlap arises in a specific episode of Hazel Barnes's TV series, where Brakhage contributed Sartre-inspired material, notably Sartre's Nausea segment filmed in Denver, later revised as Black Vision, with discussions about the extent of his involvement beyond that piece.
Bearer-Friend & Polcz on Taxing AI
Q: What are the other upsides to using stock rather than cash for the tax, beyond avoiding cash flow issues?
Stock-based taxation improves valuation accuracy, distributes burden to the wealthiest shareholders, and creates opportunities for governance and long-term public benefit rather than immediate cash transfers.
Christopher Brooks on Appellate Judicial Section
Q: What does merit selection look like?
Merit selection is where candidates apply and a commission evaluates their qualifications based on set criteria before recommending them to the governor.
Christopher Brooks on Appellate Judicial Section
Q: Could you walk listeners through what you see as the merits and demerits of appointment and election as ways of picking appellate judges?
Appointment removes the people too much at the state level, while election introduces massive money influence, altering candidate behavior.
