  • Great way to keep up with the best of legal scholarship

Love this podcast. Brian asks good questions but like a good interviewer he basically gets out of the author’s way. I have learned so much from just a few episodes and what else could you ask for? It’s like a really good law conference you can listen to at any time (like while commuting!)

Talking Points

Recent interactions between the hosts and their guests.

Christopher Brooks on Appellate Judicial Section
Q: What does merit selection look like?
Merit selection is where candidates apply and a commission evaluates their qualifications based on set criteria before recommending them to the governor.
Christopher Brooks on Appellate Judicial Section
Q: Could you walk listeners through what you see as the merits and demerits of appointment and election as ways of picking appellate judges?
Appointment removes the people too much at the state level, while election introduces massive money influence, altering candidate behavior.
Valentin Jeutner on Conceptual Legal Writing
Q: Could you expand on that a little bit?
When I work with the Nuremberg files, huge amounts of documents, I feed them into my corpus manager and I say, give me all the phrases that begin with 'I' or 'man.' I don't know what will come out.
Valentin Jeutner on Conceptual Legal Writing
Q: I wonder if you could say a little something about how the approach of conceptual legal writing is different in terms of how it does that from a more conventional approach to legal scholarship.
What sets it apart is that it does so by focusing on the esthetic appearance of law, which we conventionally don't look at.
Bill Childs on Amusement Park Law
Q: How are amusement parks regulated?
Amusement parks operate without federal oversight of rides, leading to a varied state-by-state regulatory environment that sometimes lacks consistency.
