253 The Protected Conversation Myth
Q: What is the answer to this week's quiz about disability?
The answer is that obesity is not a disability on its own, but can amount to a disability when it exacerbates other conditions, creating a compensating impact on the individual.
253 The Protected Conversation Myth
Q: Is obesity by itself a disability under the Equality Act 2010?
No, obesity by itself is generally not a disability under the Equality Act, but it can contribute to other conditions (such as mobility problems) to the point where their combined effect amounts to a disability.
256 Data, data everywhere
Q: What is the case of Toll Against GB Oils Limited authority for?
The case stands for the principle that while a worker's request to be accompanied at a disciplinary or grievance hearing must itself be reasonable, the choice of the particular person accompanying them does not have to be reasonable; employers may question timing or format of the request, but not the worker's choice of companion when that person is a union representative or a workplace colleague.
254 Zero Hours Consultation
Q: Under the statutory flexible working scheme, can an employer simply refuse a flexible working request without having a meeting?
No. The employer must deal with the request in a reasonable manner, notify the employee of the decision within the prescribed time frame, and can only refuse on statutory grounds.
252 Two weeks - no excuses
Q: What is the Ramfell case about in relation to potential unfair dismissal?
The case emphasizes that a dismissal could be unfair if the investigating or disciplinary officers are pressured or revised by people who are not the nominated decision-makers, highlighting the risk of improper interference in the process.
