  • Disappointing

I had high hopes but these were quickly dashed by the irresponsible way the Karen read trial was presented and commented on. I was completely impartial and watched the trial with an open mind. It’s a shame this guy didn’t do the same. No place in journalism for people that cannot be impartial and follow the evidence.

Talking Points

Recent interactions between the hosts and their guests.

Joseph and Kendra Duggar: Florida Life Felonies, Arkansas Misdemeanors, and a Multi-Jurisdiction Case Breaking Down
Q: Does the family's history and other allegations help or hinder the defense in this case?
While prior family misconduct can be considered for context, it is usually not admissible to prove the current charges unless it shapes mens rea or a mental- state defense, so its impact is limited in the courtroom.
Joseph and Kendra Duggar: Florida Life Felonies, Arkansas Misdemeanors, and a Multi-Jurisdiction Case Breaking Down
Q: How does this confession affect the likelihood of going to trial versus negotiating a plea?
A confession often makes trial unlikely; the defense may steer toward suppressing the statements and, if not, leaning toward a plea to shave years off the sentence.
Joseph and Kendra Duggar: Florida Life Felonies, Arkansas Misdemeanors, and a Multi-Jurisdiction Case Breaking Down
Q: Walk us through what a defense attorney is actually working with when a client has already made statements like that before an attorney is involved.
The attorney would evaluate whether the statements are suppressible, review police reports and warrants, and consider whether a plea could be a viable option if suppression fails.
Michael Jackson Cascio Lawsuit: Estate Says Extortion, Accusers Say Trafficking
Q: From a prosecutor's perspective, how devastating is this in terms of being a credibility problem for them?
The expert explains that long-standing statements defending a subject can undermine credibility; in civil cases you rely more on memories and recollection, but the credibility of the witnesses will be central, and the defense will scrutinize prior statements and any inconsistencies.
Kouri Richins Defense Strategy: Two Mistrial Motions Filed as Prosecution Relies on Shaky Witnesses
Q: Did you have this defense strategy in mind from the start, or did it evolve as the trial progressed?
The defense strategy evolved, including pushing the narrative that Eric had undisclosed activities and relationships, while also highlighting Kouri's lack of knowledge about those activities to create reasonable doubt.
