Q: My employer has a job offer with a non-compete clause in it. Is that legal or should I even bother looking at it?
You should bother looking at it because non-compete clauses are very serious. Chances are it's not legal unless you're in a C-suite position or involved in an asset purchase.

Q: My employer has a small payroll, so they say, and you know where this is going, they don't have to pay me severance because they're a small company? Is that correct?
Absolutely not correct. If you have a small company as an employer, that may impact your minimum obligations to an employee. It does not impact your full obligations to pay full severance.

Q: Can the employer change your job during the notice period?
They can within reason, but they can't significantly change your working conditions without risking a constructive dismissal claim.

Q: I can still get severance pay.
If they give you a job offer that requires you to travel all over the country, and you didn't do that before, then we might be able to say that it's really not comparable, and therefore you shouldn't have to take it, and therefore you're owed more severance.
No No's for Employers
Q: Can an employer mandate you to have a COVID vaccine?
That is probably going to be very difficult for your employer to do, but we need to look into the specifics.
