  • Want to improve legal skills?

Todd Smith and Jody Sanders have interviewed so many professionals, I have a much better understanding of how appellate courts work behind the scenes, the types of arguments they like and do not, and they do it all with humor and curiosity. If you are an attorney(you don’t have to be appellate) listening to these episodes will help you become a better one.

  • Fantastic Content

Todd Smith and Jody Sanders, two of the greatest civil appellate lawyers in Texas, conduct excellent interviews on diverse topics of interest to Texas litigation attorneys. The Texas Bar should give CLE credit for this podcast, but that would put them out of business.

This podcast has interesting topics and excellent guests providing practical helpful information in an easy to understand manner. As a lawyer practicing in another jurisdiction I recognize the law may be different, but the logic and explanations can be relatable to our work anywhere. I am enjoying listening to this very much. Keep up the good work!

  • Excellent Intro to Appellate Practice in Texas & Beyond

I’m a judicial clerk with no experience in Texas appellate practice. Yet I listen to this podcast weekly. The guests are extraordinary, and the value of their insight extends well beyond the Lone Star State.

Lies, Damn Lies, and Statistics: Judicial Accountability and the Future of the Central Docket | Judge Amy Clark Meachum
Q: What is the long-term impact on litigation strategy with these deadlines?
There is concern that deadlines will drive aggressive posturing, more withdrawals to reset clocks, and potential increases in denial rates or mandamus actions, but also opportunities for creative pleadings as lawyers adapt to the new regime.
Lies, Damn Lies, and Statistics: Judicial Accountability and the Future of the Central Docket | Judge Amy Clark Meachum
Q: Can you give practitioners a roadmap for handling summary judgments under the new rule?
The guest suggests filing only when ready for a hearing, setting hearings promptly using available calendar slots, and communicating with the specific judge about preferred hearing format (in-person, Zoom, or submission), while recognizing that practice varies by county.
AI in the Judiciary: Power, Limits, and the Social Contract | Judge Scott Schlegel
Q: What is JAIC and what is the goal for judges using AI in the judiciary?
JAIC is a forum for judges to share experiences, policies, and best practices on AI usage, with the aim of developing practical guidelines, safety protocols, and a supportive network to learn from each other while maintaining ethical standards and avoiding harm from hallucinations.
AI in the Judiciary: Power, Limits, and the Social Contract | Judge Scott Schlegel
Q: How did the adoption of Zoom and online calendars change courtroom operations during your time as a trial judge?
Zoom and online scheduling transformed efficiency and accessibility, enabling better coordinating with counsel and participants, reducing unnecessary travel, and allowing reminders and centralized scheduling; it was the start of a broader modernization that still required changes to rules and practices.
The View from the Bench: Improving Appeals, Briefs, and Oral Argument | Justice David Gunn
Q: How does your court decide when cases get argued?
It's typically up to the author judge of the case to decide whether to set an argument, based on the clarity and complexity of the issues involved.
