  • Great podcast, but please boost your volume

Interesting topics. Great presenters. Fantastic insights into transactions.

But please record or upload at a higher volume. It’s very difficult to hear at full volume on an iPhone on public transport (even with noise cancelling head phones).

Talking Points

Recent interactions between the hosts and their guests.

On Just Terms S2E5 Fair, Orderly and Transparent with Lucinda McCann Group Executive ASX Supervision
Q: How does the ASX decide when to notify ASIC, and what drives those referrals?
Notifications to ASIC are based on statutory obligations and assessed against factors like potential contravention of continuous disclosure, misleading conduct, director duties, market manipulation, and the broader impact on market integrity. The decision considers whether another regulator is better placed to act and whether the issue involves civil penalties or criminal offenses.
On Just Terms S2E5 Fair, Orderly and Transparent with Lucinda McCann Group Executive ASX Supervision
Q: Lucinda, what sorts of things trigger you picking up the phone or commencing an inquiry and what does the process look like from your end?
Enforcement is increasingly risk-based and starts with a trigger such as a media report, advisor observations, or surveillance findings. After an initial assessment, a preliminary review leads to further information requests, formal communications, and ongoing dialogue with the company and its advisors; the overall tenor depends on company response and market impact.
Banking Litigation Podcast EP59: Monthly Update – March/April 2026
Q: Do you mind explaining the background of the Unicredit case and how it reached the Supreme Court?
The case began with Spurbank issuing letters of credit for aircraft leases to Russian airlines, which were affected by Russia's invasion and sanctions. Unicredit resisted payment arguing sanctions prohibited it; the Supreme Court eventually held that Regulation 28.3 prohibited payments until licenses were obtained, connecting funds to the supply of goods, and thereby impacting whether the bank could be liable for interest or costs under SAMLA.
On Just Terms S2 E2: Inside Litigation Funding with Stuart Price CEO & Co-founder of CASL – Part 1
Q: And so we're really grateful that you're here to expose those aspects of the complex litigation environment. Could you talk a little bit about the obstacles that litigation funding has sought to overcome when it's introduced in the Australian market?
Stuart explains that litigation funding was designed to level the playing field by addressing cost barriers and ensuring fairness in testing legal merits, while recognizing that it introduces a new dynamic into the risk landscape of corporate litigation.
Investigate 360: EP14 Australian Government passes new hate crime legislation
Q: Jacqui, to start us off, what actually changed in January with the introduction of this new hate crime legislation?
The changes introduced a broad new framework under Part 53B, creating offences targeting prohibited hate groups and extending liability to organizations, with penalties and enforcement considerations that elevate the importance of due diligence and screening across value and supply chains.
