你們聽過「從母原則」跟「孩童最佳利益原則」嗎？在很久很久的以前，只要法院在審理離婚訴訟的時候，小朋友的撫養權大多是判給父親（的家庭的）！隨著性別平等意識的提升，母職的重要性被看見，後來大多數的法官變成判給了母親，因為大多數的人（包含法官）都認為母親才能勝任照顧者的角色。
更後來的後來，因為兒童權利公約的介入，法院開始以「孩童最佳利益」作為優先考量，認為小朋友的撫養權要判給最符合孩童利益的親人。
