  • Too Biased

If you’re looking for unbiased news and analysis of GovCon developments, this is not for you. If you’re looking for a GovCon analysis that stays near the shallow end of big business’s side, then you’ve found your podcast. Often, the speakers are rattling off talking points that just don’t exist in reality anymore (if they ever did). Every now and then you’ll get a thoughtful exchange of ideas that understands that federal procurement involves the government, instead of being two businesses. ... more

Talking Points

Recent interactions between the hosts and their guests.

The current government contracting environment
Q: Can you explain how the number of protests has trended in GAO versus Court of Federal Claims and why contractors might choose one forum over the other?
GAO protests have generally fluctuated but show a long-term downward trend, while Court of Federal Claims protests have risen in recent periods due to stronger agency records and compelling grounds. Contractors choose based on factors like cost, speed, access to records, and whether they expect a more favorable record or a broader review of the decision.
Interagency contracting in the new federal market
Q: What are your thoughts on the FAR Part 8 rewrite and its impact on government-wide contracting versus agency-specific contracts?
The guest emphasizes that the rewrite is geared toward ensuring government-wide controls, encouraging the use of GWACs and schedules first, and potentially reducing agency-specific contracting by guiding buyers to the most efficient, broadly applicable options.
Key trends in government contracts compliance
Q: What are the key developments in cyber and DEI enforcement that contractors should watch?
Cyber initiatives like the cyber fraud program and CMMC have mature into a major enforcement focus, driven by whistleblowers and evolving regulations, while DEI-related clauses, executive orders, and a Civil Rights Fraud Initiative are expanding FCA leverage into anti-discrimination areas, increasing audit rights and potential FCA exposure for noncompliance.
Key trends in government contracts compliance
Q: Could you summarize how the Civil False Claims Act operates and what triggers liability for government contractors?
Liability under the FCA is triggered by the knowing presentation of a false or fraudulent claim for payment, with treble damages and penalties, and the standard of proof is preponderance of the evidence rather than beyond a reasonable doubt as in criminal cases. Relators can be whistleblowers who seek significant recoveries, and a broad range of issues—from bid protests to contract claims—can fall under FCA scrutiny.
The restructuring of federal procurement
Q: What is the potential impact of AI in the federal procurement space?
AI is expected to streamline processes and support new operating models, but requires careful governance to avoid bias and ensure transparency in evaluation and decision-making.
