河南中锦律师事务所刘伟律师根据河南高院印发《关于常见犯罪的量刑指导意见（试行）》实施细则（试行）豫高法〔2024〕158号文件，总结河南法院关于适用缓刑条件，当事人及辩护人可以按照适用缓刑条件，为被告人争取缓刑。被告人被宣告缓刑，根据《刑法》第七十六条，在缓刑考验期限内，依法实行社区矫正，如果没有本法第七十七条规定的情形，缓刑考验期满，原判的刑罚就不再执行。换句话说，被法院判处的缓刑的犯罪分子在缓刑考验期内，可以不用去监狱服刑。
目前刑事案件关于量刑证据，也需要提供证据证明，很多减轻、从轻事实虽然客观存在，但是基于各种原因，可能会被遗漏，甚至公安、检察院办案时可能并非作为重点，但法官定罪量刑需要证据，没有证据可能就无法认定，这就需要辩护律师积极为当事人调查取证，从而达到减轻处罚目的。
