  • Essential listening for lawyers and clients

Just finished the “Non-discloser” podcast. As with most podcasts, I was planning on listening to this as I was on the move. I then realised how useful the content was and so I stopped, went back to the beginning and took notes! Perfect length for a podcast and great content.

Talking Points

Recent interactions between the hosts and their guests.

Pets on Divorce
Q: What role do pet-nups play, and how can they help couples?
Pet-nups formalize discussions about pet care, living arrangements, and financial responsibilities, ideally before or early in a relationship or separation. They provide a clear framework that can prevent disputes and reduce litigation.
Pets on Divorce
Q: What is the current legal position of pets in divorce proceedings, and why is reform needed?
Pets are treated as property rather than as welfare-dependent beings, which leads to inconsistent outcomes and emotionally stressful disputes. Reform is needed to introduce welfare-based criteria that reflect real-life attachments and to provide clearer guidance for judges.
Pump Court Family Law Podcast – Live from the Langham
Q: How did the Financial Remedies Court come to be and who were the key drivers behind its creation?
Judge Hess explains that the idea originated from discussions in the early 2010s, with James Mumby and Andrew McFarlane playing pivotal roles; a lift moment with colleagues helped crystallize the proposal, and Mumby approved the concept quickly, setting the path for its development.
The Family Law Podcast - Privilege against self-incrimination in public children proceedings (Part 2)
Q: Is there a privilege against self-incrimination in public law proceedings?
In public law proceedings, there is no privilege against self-incrimination; witnesses are generally expected to answer questions, with the distinction being explained through statutory provisions and case law about how admission and evidence may be treated in concurrent criminal contexts.
The impact of stress
Q: What can we do about stress?
There are techniques such as identifying stressors and using release valves to manage stress effectively.
