想跟法白的各位分享最近的一件事情, 隔壁鄰居（老人家）經常隨意往窗外防火巷亂丟垃圾。我先前有拍到證據向環保局檢舉，對方已被開罰在案。結果隔幾個禮拜後我的監視器又拍到同一人違規，我立刻再次檢舉。
沒多久，環保局稽查人員打電話給我，表示家屬有出面求情，說老人家「失智」講不聽，說他們家人很有意要解決（承諾會用木板把陽台封起來）。所以稽查人員這次打算「以勸導結案」，並跟我說「如果再發生可以繼續檢舉」。電話中我也不想為難基層，但回過頭來，我心裡其實有非常大的法理衝擊與無奈。
行政裁量與失職的界線：
廢棄物清理法在客觀構成要件成立時（有明確時間、地點、行為人影像），原則上屬於羈束處分或應告發的違規事項。稽查人員明知事證確鑿，卻僅因家屬口頭承諾要封陽台就直接以勸導結案、不予第二次開罰，站在行政法學來看，這是否已經有「怠忽職守」或「濫用行政裁量權」的嫌疑？
「情理法」還是「情理大過法」？
台灣社會常說「講情理法」，但在實際運作中往往變成「只要搬出失智、老人生病、家屬很辛苦，法律就可以無限期打折」。當基層公務員帶頭和稀泥，傳達出的訊息就是「違規成本低、悲情牌有效」，而問題也有可能得不到改善，更是在... more

砍樹跟無人機連結100%是陰謀論！而且這個算謠言吧，為何政府沒有將散佈謠言的人法辦，只是因為這個言論是政治正確的就可以被輕輕放過嗎？
突然想起來，貴節目有個賴社群裡面還有人在提倡這種陰謀論，被指正還見笑轉生氣呢！
這種言論是陰謀論在現實跟根本不堪一擊。因為同時間高雄也在砍樹，也很多是斷頭式修剪，請去看高雄愛樹人的粉絲專頁。喔我忘了熱愛陰謀論的那群人反而會攻擊高雄在地的護樹團體，而不是像譴責台北市那樣譴責高雄市亂砍樹跟造成國安危機

說穿了，這種陰謀言論在現實中根本不堪一擊，洗這種言論只是用來顯示民進黨支持者都很瘋魔，是在散佈恐懼製造對立而已，就不懂為何他們還能如此堅持而且樂此不疲。然後別人理性勸導，馬上就把人打成網軍，不然就是把錯都推給藍白，連「陰謀論是藍白教的」都說的出口。
真是不知叫人如何是好。只能說抗中保台真是一門好生意
