  • Insightful and relevant

This is one of my favorite podcast with a lot of regulation and privacy content that is not very common

  • Good content but with a nauseating liberal bias

Cyberwire Pro subscriber. The cases and discussions are informative but when it comes to the opinions expressed they are overwhelmingly left-leaning in political persuasion. The co-host attorney is your typical condescending coastal liberal elite professor type. I truly wish it was politically neutral. I will continue listening but will continue to hit skip when it comes to the nauseating hot takes.

  • Podcast doesn’t play while on VPN.

Podcast doesn’t play while on VPN. Will you please fix this? Other podcasts play without any issues. I suspect it’s a setting within how you publish your content.

Talking Points

Recent interactions between the hosts and their guests.

Sony's failed attempt to stop piracy.
Q: Take us through what this ruling changes for how intermediaries are treated when their users infringe.
The ruling makes clear that simply providing a service that can be used for infringement isn't enough for liability; liability hinges on proving inducement or that the service was designed specifically to facilitate infringement, which narrows potential cases against ISPs and similar intermediaries.
Trump’s AI Preemption Playbook.
Q: What is the practical outlook for public-private partnerships in government cyber initiatives?
Public-private partnerships are increasingly essential, requiring trust and transparency, flexible procurement, and a strategy that leverages diverse vendors while safeguarding national security and ensuring that innovation remains accessible across government agencies.
Trump’s AI Preemption Playbook.
Q: How does geofencing and targeted AI advertising raise legal concerns for individuals?
Geofencing can target individuals based on location, potentially causing reputational harm and harassment when used without consent, which can lead to claims under state likeness protections and federal trademark or IP-related theories if the individual's identity has commercial value.
Trump’s AI Preemption Playbook.
Q: What is the role of executive action in shaping AI regulation versus explicit congressional action?
Executive actions can influence state behavior and funding conditions, creating incentives or deterrents that change how states regulate AI, even without formal preemption, but they risk constitutional scrutiny and may prompt litigation to define the boundaries of federal authority.
The algorithm is writing the rulebook now.
Q: Is there something that policy makers can do in the interim between these high-profile breaches to kind of raise the salience so that you can institute these policy reforms before the storm hits?
Things like continuous monitoring and proactive testing of core infrastructure can help raise awareness and implement necessary reforms before incidents occur.
