日本の著作権は基本は「親告罪」です。
【1限目】「著作権と著作隣接権」「親告罪」
もともと日本の著作権侵害罪は「親告罪」でした。つまり、著作権者（被害者）が警察や検察に「告訴」をしない限り、刑事手続が始まらず、処罰もされません。しかし、2018年（平成30年）12月30日に著作権法が改正され、TPP（環太平洋パートナーシップ協定）に合わせて「一部の著作権等侵害罪」が非親告罪になりました。

これを著作権侵害とするのは、行き過ぎな気もしますが、実際は日本では著作者が訴えたら侵害が認められる可能性があります。
