林廷輝指出，針對近期備受關注的共諜案，最高法院對《反滲透法》做出了史無前例的見解，認定候選人只要正式登記參選，其「登記前」若有收受中國資金、接受招待或指示來干擾選舉的行為，同樣構成犯罪。這項判決對今年九合一選舉影響深遠，過往曾接受中國落地招待的潛在候選人，都可能因此觸法而面臨退選危機。
