  • Great shorter format

If you just want a SCOTUS case quickly broken down with no discussion unlike the teleforums, this is a fantastic series.

  • Jesner vs Arab Bank is bad, bad audio quality

What a horrible audio quality. I happened to start the podcast with this episode. Sounds like the guest has a paper bag over his head. Many reviews say the same thing yet you can bother to improve this?

  • Could be excellent but for the audio quality

The content is excellent, but the audio quality is so bad that it is almost always hard to listen. Please upgrade the audio quality to make this an intellectually exciting podcast.

Talking Points

Recent interactions between the hosts and their guests.

Wisconsin Bell, Inc. v. United States, ex rel. Todd Heath - Post-Decision SCOTUScast
Q: Can you explain a little bit more about the QTAM provision that Justice Kavanaugh has raised in multiple opinions?
The QTAM provision allows ordinary citizens (relators) to file false claims suits on behalf of the United States and potentially keeps a portion of any recovery, raising constitutional questions over whether this violates Article 2.
Wisconsin Bell, Inc. v. United States, ex rel. Todd Heath - Post-Decision SCOTUScast
Q: Can you take us just a quick minute or two of the oral arguments, kind of what the arguments were for both sides?
The petitioner, Wisconsin Bell, argued that since funds were provided by private parties, the case didn't fall under the False Claims Act. The respondents countered with three arguments, including that federal law required transfers between telecommunications providers and USAC, and that USAC acted as an agent of the United States.
Lackey v. Stinnie - Post-Decision SCOTUScast
Q: How do you see this changing litigation going forward, especially in the civil rights context?
The impact is likely going to be fewer civil rights cases being brought and encourages legislative gamesmanship to avoid paying fees, creating disincentives for small firms and public interest groups.
Lackey v. Stinnie - Post-Decision SCOTUScast
Q: Can you dive a little bit deeper into the reasoning behind the decision?
The court built on an earlier decision that rejected the catalyst theory for the recovery of fees, stating that a prevailing party is one who obtains enduring judicial relief that alters legal relationships, which must arise from a court, not external factors like legislation.
Macquarie Infrastructure Corp. v. Moab Partners, L.P. - Post-Argument SCOTUScast
Q: Why were you surprised with her question?
Justice Jackson focused on a narrow interpretation tied to the text, rather than on enforcement policy, which was unexpected given her generally more liberal stance.
