本集是这一部罗马史的最后一集。共而不和这个标题在这一部开头的时候还是很贴切的，随着罗马逐渐扩张，内部矛盾从某种程度上得到了化解，最起码是从内部转移到外部了，共而不和这个标题就越来越不贴切了。但是用来形容罗马对意大利的统治依然是很合适的，现在意大利在罗马的统治下，对外是一个声音了，但是内部只是在罗马的高压统治下，不得不听从罗马的指挥，但是大部分意大利城邦并不是心甘情愿地帮罗马办事，这就需要罗马化的进程来统一整个意大利的行动和思想，这急不来的。共而不和虽然越来越不贴切，但是逐渐显现出来的是黑罗马的“... more

这回讲的是罗马这个阶段的法制。这个阶段罗马的法制没有什么本质的的变化，在技术层面有了不小的进展。这个阶段的特点是罗马管制的范围逐渐深入到道德层面。共和初期，罗马人对官吏的管理非常严格，但是对老百姓管的并不严格，在这个阶段罗马增加了“扰乱秩序”罪，这个罪名几乎可以加在任何行为之上。罗马的专制已经逐渐深化了，这个阶段还没有表现出来严重的问题。而这个阶段的法律也表现出来近代化和人性化的趋势。肉刑逐渐减少，死刑更谨慎了。罗马的对于私人财产的限制有所放松。 more
