Verhandlungen erfolgen auf Spitzenverbandsebene zwischen Krankenkassen und Krankenhäusern, aber die Preise sind stark reglementiert und von Gesetzen vorgegeben, kein echter freier Markt.

Es gab vier Phasen seit dem Krieg, vielleicht eine fünfte, wenn man die Entwicklung weiterführt: unmittelbare Improvisation wegen Mangels, gefolgt von Ausweitung der Krankenhauslandschaft und dem Krankenhausfinanzierungsgesetz; danach eine Phase mit zunehmender Gewinnorientierung und Anreizen, schließlich der Strukturbruch um 2002/2003 durch das Fallpauschalensystem. Seit ca. 2018 könnte es einen weiteren Strukturbruch geben, da DRG unter Druck geraten.
