  • $ paid for by fossil fuels

Not a balanced view of energy. Great there’s another venue for singing the praises of oil and gas and the pain our kids will have to experience to deal with our inability to change and solve

    Problems.

Talking Points

Recent interactions between the hosts and their guests.

The Endangerment Finding and the Future of EPA’s Authority
Q: What are the practical implications if federal climate regulation is weakened or halted?
States could gain room to pursue their own standards, but preemption and interstate litigation would add complexity. Industry shifts, investment uncertainty, and a potential rise in state-level and court-driven actions are likely, influencing the pace and direction of climate policy.
The Endangerment Finding and the Future of EPA’s Authority
Q: How does the current composition of the Supreme Court affect the likelihood of Massachusetts v. EPA being upheld or overturned in this context?
With the original five-to-four Massachusetts majority not on the Court, the dynamics have shifted. New conservative justices could be more skeptical of broad regulatory authority, making an overruling of Massachusetts possible, though not guaranteed, depending on how the Court interprets delegation and major questions doctrine.
The Endangerment Finding and the Future of EPA’s Authority
Q: Shelley, what does the EPA actually claim it has done by rescinding the endangerment finding, and why do you think this route was chosen instead of challenging climate science directly?
The EPA frames rescission as reversing a prior finding that greenhouse gases endanger health and welfare, arguing that the agency may not have had statutory authority for that finding. They chose a legalistic path because litigating climate science would require defending complex, contested science in court, which is riskier than reexamining statutory authority under the Administrative Procedure Act.
When Oil Sanctions Meet Dark Shipping
Q: What are the implications of darkness shipping on sanctions and global trade?
Dark shipping allows sanctioned nations to continue exporting oil, thus undermining the intended impacts of sanctions and complicating the landscape of global trade.
When Oil Sanctions Meet Dark Shipping
Q: What does dark shipping consist of?
Dark shipping refers to oil tankers that operate outside sanctions imposed by designated entities, utilizing various deceptive practices to evade detection.
